About the Program
Every will is both a blueprint — and a potential liability exposure. While no will can eliminate all risk, many disputes arise from recurring and preventable drafting and process errors. In this 90-minute practical webinar, estates litigation lawyer and preferred counsel for LAWPRO, Jenny Bogod, examines common categories of will-drafting mistakes that lead to litigation and professional negligence claims. Drawing on leading jurisprudence and real-world experience, the session highlights where drafting lawyers most often get into trouble and, more importantly, how to avoid those problems at the drafting stage. By the end of the webinar, you will be able to:
- Better understand the scope of the drafting lawyer’s duties and risk exposure
- Identify recurring drafting errors that generate litigation
- Recognize clause-level vulnerabilities before they become disputes
- Implement protective drafting techniques and file practices that reduce claims and challenges

Meet Your Presenter
Jenny Bogod is a passionate litigator whose litigation practice at Rosen Sack LLP focuses on estate, trusts and capacity litigation as well as professional negligence. Jenny represents dependants, estates, beneficiaries and persons whose capacity is being questioned by others in connection with Will challenges, Will interpretation applications, power of attorney disputes, dependant support claims and guardianship applications. Jenny is also designated as Preferred Counsel by the Lawyers’ Professional Indemnity Company, the professional liability insurer for lawyers in Ontario. She acts as defence and repair counsel in connection with solicitor negligence matters related to estates and trusts, family law, civil litigation and real estate. Jenny regularly speaks and writes about estates related topics, including for the Law Society of Ontario, the OBA, Advocate Daily, CanLII Connects, and OBA Section Insider: Elder Law.
